This Privacy Policy explains what OhBet collects, why, who sees it, and what you can do about it. Some of what you do on OhBet is public by design, and some of it is recorded on a public blockchain that no one, including OhBet, can erase. Please read this before you use the Service.

1. Who We Are and What This Policy Covers

Oh, Bet LLC, a New Hampshire limited liability company doing business as OhBet ("OhBet," "we," "us," or "our"), is the controller of the personal information described in this Policy. Our address is 29 Coventry Road, Concord, NH 03301 and our email is contact@ohbet.app.

This Policy applies to the OhBet mobile applications, the websites at ohbet.app and related domains, our messaging extensions, link previews, and every other product or service that links to this Policy (together, the "Service"). Capitalized terms not defined here have the meanings given in the OhBet Terms of Service (the "Terms"), which incorporate this Policy.

This Policy does not apply to the independent practices of third parties whose services are integrated with OhBet, including Stripe, Persona, Plaid, Apple, Google, the BASE network, or any venue, Club, Business Account, or other User. Where you provide information directly to one of those parties, their privacy policy governs. Section 18 lists the main ones.

The Service is offered only to adults located in the United States in jurisdictions where OhBet is available. See Sections 16 and 17.

2. Information We Collect

2.1 Information you give us

  • Account information. Name, handle, email address, phone number, date of birth, password or sign-in credential (including through Sign in with Apple or Google), profile image, and any optional profile details you add.
  • Identity verification. When you deposit, withdraw, claim a Bounty, or cross other thresholds, we or our verification provider collect your legal name, address, date of birth, government-issued ID images and the data on them, a selfie for comparison, and, where the law or a payment partner requires it, the last four digits or the full number of your Social Security number or other taxpayer identification number. See Section 3.
  • Payment and banking. Card details you enter go directly to Stripe. OhBet receives a token, the card brand and last four digits, the billing address, and transaction results, not the full card number. If you link a bank account through Plaid, Plaid collects your bank credentials and shares account and routing identifiers, account ownership, and balance information with OhBet as needed to verify and fund transactions.
  • Tax information. Form W-9 or other tax documentation when you approach or exceed a reporting threshold, and your consent to receive tax forms electronically.
  • Challenge content. Challenge titles, descriptions, categories, Stakes, Timers, Confirmation Signals, Challenge Media (photos and videos), comments, reactions, Club and Bounty details, and everything else you post or send through the Service.
  • Communications. Messages you send other Users through the Service, messages you send us (support, disputes, reports, opt-outs, privacy requests), and survey or Promotion entries.
  • Voice input. If you use voice features, the audio you speak and the transcript produced from it. See Section 4.
  • Responsible-use settings. Deposit and Stake limits and self-exclusion requests you set.

2.2 Information we collect automatically

  • Device and app data. Device model, operating system and version, app version, language, time zone, screen settings, device identifiers such as the vendor identifier, push notification tokens, and mobile network information.
  • Precise location. Your device's GPS or equivalent location when you sign up, when you deposit or withdraw, and each time you lock a Stake, along with the IP address, VPN or proxy indicators, and other signals used to confirm where you are. Location permission is required to use funded features. See Section 3.
  • Usage and log data. Screens viewed, features used, Challenges created, accepted, confirmed, and settled, search terms, referral sources, session times, crash and performance data, and the time, date, and IP address of your requests.
  • Security and fraud signals. Device fingerprinting, behavioral patterns, velocity of transactions, links between accounts, and similar signals used to detect multi-accounting, collusion, fraud, and abuse.

2.3 Information from other sources

  • Verification and fraud providers. Results and risk signals from Persona (identity), Stripe (payments and Stripe Radar fraud scoring), Plaid (bank verification), and sanctions, watchlist, and fraud database checks.
  • Sign-in providers. If you sign in with Apple or Google, the name and email address (or relay address) they share with us.
  • Contacts. If you choose to allow it, hashed contact identifiers from your address book so we can show you which of your contacts are on OhBet. We do not upload your full address book and we do not keep contact data for people who are not Users beyond the match.
  • Other Users. Information other Users provide about you, such as inviting you to a Challenge, tagging you in Challenge Media, reporting you, or disputing a Challenge with you.
  • Public blockchain. Transaction records on the BASE network associated with the wallet address used for your Account. See Section 5.
  • Clubs, Venues, and Business Accounts. Leaderboard entries and Bounty claims associated with you.

3. Sensitive Information: Identity, Biometrics, Location, and Financial Data

Some of what we collect is treated as sensitive under state privacy laws. We collect it only for the purposes below, we do not sell it, and we do not use it for advertising.

3.1 Government identification and tax identifiers

We collect ID documents and taxpayer identification numbers to verify your identity and age, to confirm you are located in a permitted jurisdiction, to comply with anti-money-laundering, sanctions, and know-your-customer obligations that apply to us and to our payment partners, to detect and prevent fraud and multi-accounting, and to file tax information returns when required. These records are retained for the periods in Section 14 even after you close your Account, because the law requires it.

3.2 Biometric information

When verification requires a selfie, our verification provider creates a facial geometry template from your selfie and compares it with the photo on your ID to confirm that you are the person on the document. This is biometric information under some state laws, including the Illinois Biometric Information Privacy Act. By submitting a selfie you consent to this collection and processing. We and our provider use biometric information only to verify identity and prevent fraud. We do not sell, lease, or trade it, we do not use it to identify you in Challenge Media or elsewhere, and we do not use it for advertising. Biometric templates are permanently destroyed when the purpose for which they were collected has been satisfied, and in any event no later than three (3) years after your last interaction with the Service, or sooner where state law requires. The verification images themselves are retained under Section 14 as identity records, not as biometric identifiers. You may decline to provide a selfie, but you will not be able to use funded features that require it.

3.3 Precise geolocation

The Service is not lawful in every state. We collect your precise location at signup, at deposit and withdrawal, and each time you lock a Stake, and we may check it at other times when we detect signals of location spoofing, to confirm that you are in an Eligible Jurisdiction and to enforce the Terms. Location is a required permission for funded features. We keep location checks tied to specific events as part of the transaction record, and we do not build a continuous location history or use location for advertising.

3.4 Financial account information

Card tokens, bank account identifiers, balance verification, transaction history, and wallet addresses are used to fund your Account, process withdrawals, settle Challenges, prevent fraud, resolve payment disputes, and meet our reporting obligations. Full card numbers and bank credentials are held by Stripe and Plaid respectively, not by OhBet. Some of this information is nonpublic personal information under the Gramm-Leach-Bliley Act, and to that extent it is governed by that law and by our partners' obligations under it rather than by state consumer privacy laws.

4. Voice Input and AI Features

If you use voice input to draft a Challenge, your device converts your speech to text using the operating system's speech framework (on Apple devices, the Apple Speech framework, which may process audio on the device or on Apple's servers under Apple's terms). The resulting transcript is sent to OhBet and may be sent to a third-party AI provider acting as our service provider to extract the Challenge terms (for example, the counterparty, the Stake, and the description). The provider is contractually restricted to processing the transcript for that purpose, may not use it to train models, and may not retain it beyond what is needed to return the result. OhBet does not retain the audio. We retain the transcript only as part of the draft until you confirm or discard the Challenge, and the confirmed Challenge terms are stored like any other Challenge content. Voice features are optional. If you do not want your speech processed this way, type your Challenge instead.

AI-generated drafts, suggestions, and transcriptions are provided for convenience and are not reviewed by a person before you see them. You are responsible for checking them before you lock a Stake.

5. Blockchain Data

Stakes are held and released by the Protocol Contract on the BASE network, a public blockchain. Every deposit into, movement within, and release from the Protocol Contract is recorded on that network, together with the wallet addresses involved, the amounts in USDC, timestamps, and transaction identifiers. These records are public, permanent, and outside OhBet's control. OhBet cannot edit, delete, or restrict access to them, and requests to delete your Account or your personal information do not reach them.

On-chain records are pseudonymous: they show wallet addresses, not names or handles. However, OhBet maintains the link between your Account and your wallet address, and anyone who learns that link (for example, because you shared a transaction link or because a settled Challenge is public) could associate on-chain activity with you. Treat wallet addresses and transaction identifiers as potentially identifying, and consider that anyone with the address can view the full history associated with it.

6. How We Use Information

We use personal information for the following purposes and for no others without telling you first:

  • To create and administer your Account, authenticate you, and provide the Service, including creating, accepting, confirming, and settling Challenges, Group Challenges, Bounties, Clubs, and Premium.
  • To verify your identity, age, and location, and to determine whether you are eligible to use funded features.
  • To fund your Account, process withdrawals, calculate and collect Fees, and keep transaction records.
  • To detect, investigate, and prevent fraud, money laundering, sanctions violations, multi-accounting, collusion, chargeback abuse, and other Prohibited Conduct, and to comply with anti-money-laundering and know-your-customer obligations.
  • To calculate and display Reputation Scores, leaderboards, and other indicators, and to operate the social feed and Trending.
  • To respond to disputes, reports, chargebacks, and support requests, and to enforce the Terms.
  • To send transactional and service messages (Challenge invitations, confirmation reminders, Timer alerts, settlement notices, security alerts, tax forms, and changes to the Terms or this Policy).
  • To send marketing messages where you have opted in or where permitted by law, subject to your right to opt out.
  • To provide responsible-use tools and honor limits and self-exclusion requests.
  • To maintain security, debug, and improve the Service, including analyzing usage patterns and testing features.
  • To comply with law, respond to legal process and government requests, file information returns, and protect the rights, safety, and property of OhBet, Users, and others.
  • To operate Promotions and administer prizes.
  • To create aggregated or de-identified data that does not identify you, which we may use for any purpose.

6.1 Automated decisions

We use automated systems to verify identity, screen for fraud and location spoofing, rank content, and flag accounts for review. Some of these can restrict your Account or block a transaction without a person reviewing it first. Where a decision has a significant effect on you, such as an Account suspension or a declined withdrawal, you can request human review by contacting us under Section 20, and the appeal process in Section 12 applies.

6.2 No sale, no targeted advertising

OhBet does not sell personal information, does not share it for cross-context behavioral advertising, and does not currently include any advertising or ad-attribution software development kits in the app. If that changes, we will update this Policy and, where the law requires, give you the ability to opt out before the change takes effect.

7. How We Share Information

We share personal information only as described here.

We do not share personal information with influencers, ambassadors, or marketing partners, other than aggregated performance data.

8. Public Content and What Other Users See

OhBet is social. The following are visible to all Users and, through link previews and web pages, may be visible to people who are not Users: your handle, profile image, Reputation Score, Club memberships and leaderboard positions, and settled Challenges that include Challenge Media, together with the Challenge description, the Stake amount, the outcome, the Participants' handles, comments, and reactions. Trending shows selected settled Challenges to everyone, ranked by automated signals as described in the Terms.

Where the Service offers privacy settings, they control what is shown. Anything shown to other people can be screenshotted, recorded, downloaded, or reshared outside the Service, and we cannot control what other people do with it. Deleting content removes it from the Service and from Trending but does not remove copies that others have already made. Do not post content, or include people in Challenge Media, that you would not want to be public.

Your legal name, email, phone number, date of birth, identity documents, payment and bank details, tax information, location data, and self-exclusion settings are never shown to other Users.

9. Website, Cookies, and Tracking

Our website uses only the cookies and similar technologies needed to operate it, remember your preferences, and measure aggregate traffic. We do not use third-party advertising cookies, pixels, or cross-site trackers. If we add analytics tools, they will be configured to avoid collecting personal information beyond what this Policy describes, and we will update this Section. We treat a Global Privacy Control signal from your browser as a request to opt out of any sale or sharing of personal information; because we do neither, the signal does not change how we operate, but we honor it. We do not respond to Do Not Track signals, which have no agreed meaning.

The app does not use cookies. It uses device identifiers and push tokens as described in Section 2.2.

10. Push Notifications, Email, and Text Messages

With your permission, we send push notifications for Challenge invitations, confirmation reminders, Timer alerts, settlement notices, security alerts, and other Service events. You can turn push notifications off in your device settings at any time; if you do, you may miss time-sensitive Challenge notices, and Timers will still run.

We send transactional emails about your Account, transactions, tax forms, security, and changes to the Terms or this Policy. You cannot opt out of those while you have an Account. We send marketing emails only where you have opted in or where the law otherwise permits, and every marketing email includes an unsubscribe link.

If you give us your mobile number and consent to text messages, we may send Service and, with separate consent, marketing texts. Message and data rates may apply. Reply STOP to stop and HELP for help. Consent to marketing texts is not a condition of using the Service.

11. Your Choices

  • Profile and content. Edit your profile, delete Challenge Media and comments, and adjust any privacy settings the Service offers.
  • Permissions. Control camera, microphone, contacts, photo library, and notification permissions in your device settings. Location permission is required for funded features and cannot be disabled while using them.
  • Contacts matching. Decline the contacts permission or revoke it later; we then delete the hashed identifiers we hold.
  • Voice. Type instead of speaking to avoid voice processing.
  • Marketing. Unsubscribe from emails, reply STOP to texts, or email us under Section 20.
  • Account deletion. Delete your Account in the app or by request. We will delete or de-identify your personal information subject to the retention rules in Section 14, the permanence of blockchain records in Section 5, and any pending Challenges, holds, disputes, or legal obligations. Public content that other Users have already reshared may persist.

12. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights under state law, including the laws of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia. OhBet extends these rights to all Users regardless of residence, subject to the limits below.

  • Access. Confirm whether we process your personal information and obtain a copy of it.
  • Correction. Correct inaccurate personal information. Identity verification records may require a new verification rather than an edit.
  • Deletion. Delete personal information we hold about you, subject to Section 14 and Section 5.
  • Portability. Receive a copy of the personal information you provided in a portable, readily usable format.
  • Opt out. Opt out of the sale of personal information, sharing or targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects. We do not sell, share for targeted advertising, or profile in that way; if that changes, we will provide an opt-out.
  • Sensitive data. Withdraw consent to the processing of sensitive personal information. Because verification, location, and financial data are required to use funded features, withdrawal will end your ability to use those features.
  • Appeal. If we decline a request, you may appeal by replying to our decision or emailing us with the subject line "Privacy Appeal." We will respond within the period the applicable law allows and, if we deny your appeal, tell you how to contact your state attorney general.
  • No discrimination. We will not deny the Service, charge different prices, or provide a different level of service because you exercised a right, except where the requested action makes the Service impossible to provide (for example, deleting verification data required to withdraw funds).

12.1 How to submit a request

Email contact@ohbet.app with the subject line "Privacy Request," or use any in-app privacy tool we provide. We will verify your identity before acting, typically by confirming control of the email address on your Account and, for sensitive requests, by asking for additional information that matches our records. An authorized agent may submit a request on your behalf if the agent provides written authorization signed by you and we can verify your identity. We respond within forty-five (45) days, extendable once by a further forty-five (45) days where reasonably necessary, and we will tell you if we need the extension. We do not charge for requests unless they are manifestly unfounded, excessive, or repetitive.

12.2 Limits

We may decline all or part of a request where the law permits, including where the information is needed to complete a transaction, detect fraud or security incidents, comply with legal obligations (including anti-money-laundering and tax record retention), exercise or defend legal claims, or where the information is governed by the Gramm-Leach-Bliley Act or another law that provides its own rules. We cannot delete or alter records on the BASE network. We will tell you the reason for any decline.

13. State-Specific Disclosures

13.1 California

This Section supplements the Policy for California residents under the California Consumer Privacy Act as amended by the California Privacy Rights Act. In the preceding twelve months we have collected the following categories of personal information, from the sources and for the purposes described in Sections 2 and 6, and disclosed them to the categories of recipients in Section 7 for business purposes:

We use sensitive personal information only for the purposes permitted by Cal. Civ. Code 1798.121(a) and the implementing regulations, which do not require a right to limit. We retain each category for the periods in Section 14. We have not sold or shared personal information in the preceding twelve months and have no actual knowledge that we sell or share the personal information of anyone under sixteen. California residents have the rights in Section 12, including the right to know, delete, correct, and opt out, and the right not to be discriminated against. Under California's "Shine the Light" law (Cal. Civ. Code 1798.83), we do not disclose personal information to third parties for their direct marketing purposes.

13.2 Connecticut, New Hampshire, and other states

Residents of Connecticut, New Hampshire, and the other states listed in Section 12 have the rights described there, including the right to appeal. We process sensitive data (government identification, precise geolocation, biometric data, and financial account information) only with your consent, which you give when you use the features that require it, and only for the purposes in Section 3. We do not engage in targeted advertising, sale, or profiling in furtherance of decisions that produce legal or similarly significant effects, other than the eligibility and fraud determinations described in Section 6.1, which you can appeal.

13.3 Illinois

Section 3.2 is our written policy on biometric information, including our purpose, retention schedule, and destruction guidelines, as required by the Illinois Biometric Information Privacy Act. We do not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information.

13.4 Nevada

We do not sell covered information as defined under Nevada law. Nevada residents may nonetheless submit an opt-out request under Section 20.

14. Data Retention

We keep personal information for as long as needed for the purposes in this Policy and as required by law. Typical periods:

When a retention period ends we delete or de-identify the information. Backups are purged on a rolling schedule.

15. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest, access controls and logging, tokenization of payment data through Stripe, and vendor due diligence. Identity documents and biometric data are handled by our verification provider under its own security program. No system is perfectly secure, and we cannot guarantee that personal information will never be accessed, disclosed, altered, or destroyed without authorization. You are responsible for keeping your credentials and device secure and for reporting suspected compromise to contact@ohbet.app with the subject line "Security." If a breach affects you, we will notify you and any regulator as the law requires.

16. Children

The Service is for people who are at least eighteen (18) years old, or older where the Terms require. We do not knowingly collect personal information from anyone under eighteen. If we learn that we have, we will close the Account and delete the information, except to the extent we must keep a record of the closure. If you believe a minor has provided us information, contact us under Section 20. We honor age signals provided by app platforms and may use them to restrict access.

17. Where Data Is Processed

The Service is offered in the United States and personal information is stored and processed in the United States. Some service providers may process data in other countries under contracts that require protection consistent with this Policy. If you access the Service from outside the United States, you do so at your own initiative and your information will be transferred to and processed in the United States, which may not provide the same protections as your home jurisdiction.

18. Third-Party Services

The following third parties collect information directly from you or process it under their own terms when you use the related feature. We encourage you to review their policies.

19. Changes to This Policy
